Terms and conditions

The Platform is run by [company name], IDNO [company number], registered at [registered address], Republic of Moldova (the “Operator”, “we”).

You can write to us at any time at support@mvpoker.md.

The Terms are a contract between you and the Operator. You accept them when you create an account (by ticking the consent box) or when you use the Platform in any other way. If you do not agree, do not use the Platform.

The rules shown on the Platform for each game, tournament or feature, the Privacy policy and the Play responsibly page are part of the Terms.

• Account – your personal account on the Platform, identified by an email address and a nickname.
• Play chips (“chips”) – virtual units used at the poker tables and in tournaments. They are not money, electronic money, securities or claims.
• Gems – rare virtual units received as rewards, used for cosmetic content, reactions and some tournaments. They have no monetary value either.
• Virtual content – chips, gems, avatars, frames, reactions, achievements, levels and any other virtual item on the Platform.
• User (“you”) – the person using the Platform.

Under Law no. 291 of 16 December 2016 on the organisation and conduct of games of chance, a game of chance requires all of the following: (a) a participation fee – a stake in money or its equivalent, paid directly or indirectly by the player for the right to play; (b) a potential prize offered by the organiser; and (c) prizes awarded wholly or partly by chance.

On MVPoker the first two are missing:

• you pay nothing to play: the account is free, and chips and gems are given for free (chips on sign-up, daily bonuses, missions, levels, achievements, leaderboards, rescue chips);
• the Operator does not sell chips or gems and receives no money or other value for them or for the right to play;
• chips and gems cannot be exchanged for money, goods, services or anything of value, and cannot be withdrawn, refunded, sold or transferred outside the game;
• tournament and leaderboard prizes are virtual only (chips, gems, achievements) and have no monetary value.

MVPoker is therefore a game for entertainment and not an activity in the field of games of chance within the meaning of Law no. 291/2016 (including games of chance organised through electronic communication networks). The Operator does not organise games of chance, accept stakes or pay winnings.

Results on MVPoker do not mean you would get the same results at real-money poker.

• The Platform is only for people aged 18 or over. By creating an account you confirm that you are at least 18.
• One account per person. Multiple accounts, accounts made for someone else and bought or borrowed accounts are not allowed.
• Your account details (email, date of birth, raion) must be true and your own.
• You are responsible for complying with the laws of the country you access the Platform from. We may restrict access from some countries.

• Keep your password safe and do not share it. You are responsible for everything that happens in your account.
• Nicknames and avatars must not be offensive, obscene or discriminatory, impersonate other people, the MVPoker team or moderators, or advertise. We may ask you to change them or change them ourselves.
• If you notice unauthorised use of your account, write to us at support@mvpoker.md straight away.

Virtual content is made available to you under a personal, limited, non-transferable and revocable right of use, within the Platform only. It does not become your property.

• Chips are used at the tables (buy-ins), for tournament entries, reactions and other game features. Cash pots that reach the flop carry a 5% rake (at most 2 big blinds), and tournament entries include a fee of 10% of the buy-in. These are rules of the game: the chips taken leave the game and are not money income.
• Gems are used for avatars, premium reactions and special tournaments.
• We may correct balances affected by technical errors, abuse or breaches of the Terms, and may change the game economy (bonuses, prices, rake, fees) to keep the game balanced.
• Virtual content cannot be moved between accounts other than by ordinary play at the table.
• When an account is closed its virtual content is lost, without any compensation.

The Platform does not currently sell virtual content. If purchases are introduced, they will have separate conditions, published in advance, that respect consumer rights under the law of the Republic of Moldova.

You may not buy, sell or offer for sale chips, gems, virtual content or MVPoker accounts for money or anything else of value, on or off the Platform, or advertise such services. The Operator does not recognise such deals. The accounts involved may be closed and virtual content obtained this way may be removed.

Cards are shuffled by a verifiable generator: after each hand you can check for yourself, on the table page, that the shuffle was not altered.

The following are forbidden:

• collusion between players, sharing information about cards and playing “as a team”;
• losing chips on purpose to another account (chip dumping) and artificially boosting accounts;
• using several accounts, automated programs (bots), scripts or real-time assistance software;
• exploiting technical errors instead of reporting them;
• attacks on the Platform, unauthorised access and automated data collection.

Depending on how serious a breach is, we may issue a warning, remove chips or prizes obtained unfairly, restrict chat, suspend the account or close it permanently.

To keep tables active, some opponents may be automated players run by the Platform. They play by the same rules as everyone else, never see anyone’s cards and are not marked separately. Leaderboard prizes go to real players only.

Chat and table reactions are there for a friendly atmosphere. Insults, threats, obscene language, hate speech and discrimination, spam, advertising, links to other services, other people’s personal data and commenting on cards during a hand are not allowed.

Players can report messages and moderators review them; moderators can hide messages and temporarily restrict chat. You can hide a player’s messages at any time.

• The rules of each tournament (entry, blind structure, prizes, late registration) are shown on its page and are part of the Terms.
• Prizes are virtual only and are awarded automatically when the tournament or leaderboard period ends.
• If a tournament cannot start or continue for technical reasons, we may cancel it; entries are then returned in chips or gems, as the case may be.
• We may check results and remove prizes obtained by breaching the Terms.

MVPoker is a game for entertainment. Take breaks, decide how long you play and do not let the game affect your sleep, work, studies or relationships. If you feel you are losing control, stop and write to us: we can close your account at your request. Find out more on the Play responsibly page.

The Platform, its code, design, graphics, logo and the MVPoker name belong to the Operator or its licensors. You may use them only to play, for personal and non-commercial purposes. You may not copy, modify, decompile or distribute the Platform or any part of it.

We do our best to keep the Platform running without interruption, but cannot guarantee it. There may be maintenance, errors or outages. We may change, add or remove game features at any time.

To the extent permitted by law, the Operator is not liable for the loss of virtual content, for outages or technical errors, or for indirect damage arising from use of the Platform. As virtual content has no monetary value, its loss gives no right to compensation in money. Nothing in the Terms limits liability that cannot be limited by law or your rights as a consumer.

You can ask us to close your account at any time by writing to support@mvpoker.md from your account’s email address.

We may suspend or close an account that breaches the Terms, endangers the security of the Platform or other players, or where the law requires it. If you disagree with a sanction, write to support@mvpoker.md and the case will be reviewed.

We process your personal data under Law no. 133 of 8 July 2011 on personal data protection. The details are in the Privacy policy.

We may change the Terms when the law, the game or the Platform’s features change. The new version is published on this page with its date. We announce important changes on the Platform before they take effect. Continuing to use the Platform after that means you accept the new version.

The Terms are governed by the law of the Republic of Moldova. We first try to settle any disagreement amicably: write to support@mvpoker.md and we will answer within 30 days. As a consumer you may also turn to the Agency for Consumer Protection and Market Surveillance. Disputes not settled amicably are resolved by the competent courts of the Republic of Moldova.
